Disability Law: Workers Compensation Benefits
June 23rd, 2008Workers compensation benefits (workers comp) for employees who are both non-military and employed by the federal government are mandated by the Federal Employment Compensation Act. Under this act, a disabled employee receives two thirds of her original monthly salary during the disability term. The employee may receive more for permanent physical injuries, or if she has dependents. The act also provides compensation benefits for survivors of workers who are killed.

The Illinois Workers Compensation Act provides financial protection to workers who have sustained an on-the-job injury. In exchange for workers comp benefits, employees give up their rights to sue their employers at a later time for work-related injuries.
Workers compensation benefits cover injuries that occur during the workers tenure in the company and any repetitive trauma injury, such as carpal tunnel syndrome. Even pre-existing conditions that become aggravated can receive workers comp benefits.
Workers Compensation Benefits Can Be Extensive
In Illinois, workers are entitled to 100 percent of reasonable and necessary medical expenses. Workers also receive authorization to see their own doctors and doctors referred through the original physicians(s). Workers are also entitled to temporary total disability benefits, which are calculated based on two thirds of the employees salary.
